Assembly Bill 2774, effective January 1, 2011, changed how Cal/OSHA classifies serious violations. AB 2774 amended California Labor Code Section 6432. A serious violation now exists when there is a realistic possibility of death or serious physical harm. The law followed federal OSHA criticism that California's penalties were too lax.
Yes. Under AB 2774, Cal/OSHA must give the employer notice and a chance to submit information before issuing a serious citation. An employer may also rebut the serious classification. It must show it did not know, and could not have known with reasonable diligence, about the violation.
California employers must report a serious injury, illness or death to Cal/OSHA immediately, which means within eight hours of learning of it. That is stricter than federal OSHA, which allows 24 hours for hospitalizations, amputations and eye losses. Because the video dates from 2011, check current Cal/OSHA rules.
Employers can prepare for Cal/OSHA serious violation citations by keeping their Injury and Illness Prevention Program current and enforced. Title 8 Section 3203 requires that program. Document inspections, training and hazard corrections. Respond promptly to any notice that Cal/OSHA intends to classify a violation as serious.
